The claim for a public servitude by prescription fails due to statutory bar; vetustas does not apply as the land was state-owned and the origin is known. However, Tannenhof is landlocked and entitled to a right of way of necessity over the applicants' property, subject to payment of just and fair compensation. The applicants' request to interdict use of the road and to compel construction of an alternative route is refused.
