Ratio Decidendi

The arbitrator’s findings that the dismissal was both procedurally and substantively unfair were reasonable on the evidence. The respondent was not afforded a fair hearing, was denied the opportunity to present his case and call witnesses, and the employer failed to discharge the burden of proof. The absence of the CCTV footage, which the employer sought to rely on, further undermined the employer’s case. The award of reinstatement and compensation was justified.
