Procedural Posture

Civil Appeal / Judgment on Appeal From Administrative Tribunal

  1. 1 Whether the appeal committee was properly constituted under the Medical and Dental Council Act 10 of 2004
  2. 2 Whether the appeal committee became functus officio after delivering its ex tempore judgment
  3. 3 Whether the Executive Committee of the Council was empowered to decide on the appellant's application for extension

Ratio Decidendi

The appeal committee's decision was a nullity as it was not properly constituted in law, failed to comply with statutory requirements for decision-making, and violated the functus officio principle by issuing two judgments. The Executive Committee was empowered to act between Council meetings, but the removal of the appellant's name from the register was procedurally improper. The matter must be remitted to a differently constituted appeal committee for a fresh hearing.

Court Disposition

appeal upheld

Orders

  • The decision of the appeals committee dismissing the appellant’s appeal is set aside.
  • The matter is remitted to the appeals committee to hear the appellant’s appeal afresh.
