Ratio Decidendi

The Supreme Court held that the High Court correctly found the only issue in dispute was quantum, as liability for unlawful arrest, detention, and impounding of the vehicle was admitted at trial. The award of N$300,000 for unlawful arrest and N$27,000 for the missing cash was appropriate and supported by the evidence. However, the respondent failed to prove loss of profit, as only gross income was shown and no evidence of expenses or profit was provided, nor was available documentary evidence produced. Therefore, absolution from the instance was ordered on the loss of profit claim.
