The Rule 61 application was dismissed as it was filed out of time and after further steps had been taken in the cause with knowledge of the alleged irregularities. The condonation application for late filing of the Rule 97(3) application was refused because the applicants failed to provide a full and reasonable explanation for the delay, the delay was found to be wilful, and the application itself was defective. Costs were awarded against the applicants on an attorney and own client scale, not capped under Rule 32(11), as a mark of the court's disapproval of their conduct.
