Ratio Decidendi

The redistribution agreement was invalid as the second respondent did not have consensus ad idem when signing, having not understood she was relinquishing her half share. The claim to set aside the agreement was vindicatory, not a debt, and thus not prescribed after three years. The second respondent is entitled to her half share in the joint estate. Neither the applicants nor the second respondent should be appointed as administrator due to acrimony; an independent administrator should be appointed by the President of the Law Society of Namibia.
