Ratio Decidendi

The deputy-sheriff, as statutory owner, must formally offer the farm to the State before any sale is enforceable; failure to do so does not render the sale null and void but unenforceable until the statutory process is followed. The Minister cannot negotiate with the registered owner once the deputy-sheriff is the owner. The deputy-sheriff is ordered to comply with the Act, and the Minister must act within prescribed timeframes.
