Both parties were negligent in causing the collision. The plaintiff’s driver, although in a privileged vehicle, failed to ensure it was safe to turn right and encroached into the defendant’s lane, acting on an incorrect assumption of absolute right of way. The defendant failed to keep a proper lookout and did not see the plaintiff’s vehicle when she should have. The plaintiff’s negligence was greater, apportioned at 70%, and the defendant’s at 30%.

Court Disposition

Judgment for both parties in apportioned damages; costs apportioned accordingly.

Orders

  • Judgment in favour of the plaintiff to the extent of 30% of its claim, being N$87,150.
