Ratio Decidendi

The High Court has inherent jurisdiction to stay the execution of the Magistrate's order pending appeal to prevent injustice and preserve the State's right to appeal. Section 34(4) of the Criminal Procedure Act, 1977 does not apply as the necessary jurisdictional facts are absent. The Magistrate need not be joined as a party. The State may apply for a stay before leave to appeal is granted. The State established a prima facie right to appeal and the requirements for interim relief are met.
