Ratio Decidendi

The Electoral Court has jurisdiction to hear the matter despite non-compliance with s 170(2) of the Electoral Act, as the provision is directory, not peremptory. Schedule 4(4) of the Constitution does not permit a political party to alter its gazetted candidate list after the poll except in the limited circumstances set out in s 110(4) of the Electoral Act. The Electoral Commission acted ultra vires in amending the gazetted list at the instance of PDM. The swearing in of the affected respondents was unconstitutional, unlawful, and null and void.
