Procedural Posture

Civil / Ruling on Interlocutory Applications (attachment to Found Jurisdiction, Joinder, Edictal Citation, Counter Application, Condonation, and Striking Out)

  1. 1 Whether the court has jurisdiction over peregrini defendants via attachment of claims
  2. 2 Whether the plaintiff can attach a claim it disputes exists
  3. 3 Whether the counter-application for payment guarantee should be granted

Ratio Decidendi

The plaintiff failed to establish, on a balance of probabilities, that the claims it sought to attach exist and are the property of the proposed defendants. The plaintiff cannot attach a claim it disputes exists. The application for attachment to found or confirm jurisdiction is dismissed. The counter-application for a payment guarantee is also dismissed as the defendants did not establish entitlement. The surrejoinder affidavit was an irregular step and is set aside. The words 'opportunistically and deceitfully' are struck out as scandalous and prejudicial.

Court Disposition

Plaintiff's application for attachment to found or confirm jurisdiction dismissed; counter-application dismissed; costs orders issued; procedural directions given.

Orders

  • Plaintiff's application for condonation of late filing of affidavits granted.
  • Defendants' application for condonation of late filing of affidavits granted.
