Ratio Decidendi

Section 30 of the Banks Act provides an alternative statutory method for the transfer of real rights in a mortgage bond upon a bank merger, such that the rights and obligations under the bond vest in the amalgamated institution by operation of law upon Ministerial approval, without the need for registration or endorsement by the Registrar of Deeds. Thus, the plaintiff's claim remained secured by the mortgage bond after the merger.
