The Court ordered specified files found by the independent reviewer to be non-privileged to be delivered to the trustees on a fixed date unless the English Court requests suspension; for documents where privilege is contestable the Court directed affidavit evidence from the NZ solicitors identifying instructing persons and entitlement to waive privilege, supervised inspection by the independent solicitor and an examination of Mr Richards before an Associate Judge under s166 Insolvency Act 2006 (to be conducted by Mr Whale as the Court's agent) to resolve disputes; electronic devices were withheld pending further technical consideration; costs reserved.
