MACPHERSON v MACPHERSON [2018] NZHC 240
Medical evidence established the trustee's irreversible severe dementia rendering him incapable of performing trustee duties; because the power to appoint trustees required joint action and could not be exercised while he remained a trustee, the Court properly exercised its inherent jurisdiction to remove him as trustee and, pursuant to s52 Trustee Act 1956, vested the trust land in the remaining trustees to allow proper administration and sale in beneficiaries' best interests.
