Procedural Posture

Lease Dispute Under Property Law Act 2007 / Interlocutory Application to Stay Proceedings and Refer to Arbitration

  1. 1 Whether Hortiventure waived right to rely on dispute resolution clause by filing Disputes Tribunal claim
  2. 2 Whether there is any bona fide dispute between the parties with regard to the matters in the PLA notice
  3. 3 Whether service of a trespass notice by Hortiventure constituted a step in the proceeding forfeiting its right to seek a stay

Ratio Decidendi

The Court found Hortiventure had not waived its contractual arbitration right, was asserting bona fide disputes over the PLA notice, and had not taken a disqualifying step in the proceedings by serving the trespass notice; accordingly under art 8(1) the High Court must stay the proceedings and refer the dispute to arbitration and it was appropriate to refer directly to arbitration and provide for appointment of a single arbitrator by the President of the NZ Law Society if the parties could not agree.

Court Disposition

Proceedings stayed and referred to arbitration

Orders

  • Application for stay granted and dispute referred directly to arbitration
  • If the parties are unable to agree upon a single arbitrator within 10 working days of judgment then a single arbitrator shall be appointed by the President of the New Zealand Law Society
