The High Court allowed the appeal and held the parties' Contracting Out Agreement dated 9 May 2008, signed after independent legal advice and operating to fix the parties' property consequences, attracted significant weight; on the balance of probabilities the de facto relationship commenced on 10 June 2006 (the date the parties nominated), not earlier. Consequently the relationship was of short duration at the deceased's death and the Family Court's finding of an earlier commencement was set aside.
