"Possession" in s 31(1)(f) of the Passports Act 1992 includes the ordinary legal meaning of possession (actual or potential physical custody or control together with knowledge/intention) and is not limited to physical 'in the hand' custody; the District Court Judge erred in law by treating possession as requiring only physical in-hand possession, and there was sufficient evidence that a jury could reasonably find control, so the s 347 discharge was set aside and a retrial directed subject to the Crown's election.
