The Authority was joined as a respondent because it occupies a unique public regulatory role analogous to the Commerce Commission and requires party status in the High Court appeal to protect appeal rights in respect of public interest issues; industry participants who had complained to and participated in the Authority's process and who have direct interests in the outcome ought to have been joined as respondents and therefore were joined; respondents may support the Authority on alternative grounds but must file and serve a memorandum setting out such grounds within ten working days; Pulse Utilities was permitted to intervene and confidentiality orders and a limited stay were made.
