The defendant failed to comply with the statutory demand, creating the s287 presumption of inability to pay; there was no evidence to rebut the presumption, the proposed Part 14 compromise could not succeed because the plaintiff (major creditor) would not support it, and serious allegations of misuse of employee trust monies and preferential payments required investigation; accordingly the Court exercised its discretion under s241(4) to place the company into liquidation and appointed liquidators, approved their remuneration and permitted them to act individually.
