Procedural Posture

Civil Insurance Dispute / Summary Judgment (final Judgment on Summary Judgment Application)

  1. 1 Whether Crystal's interest in Warner's Hotel as lessor/owner was insured under the Allianz 2011 policy
  2. 2 Whether defendants are estopped from denying Crystal's interest in Warner's Hotel was insured under the 2011 policy

Ratio Decidendi

On construction of the 2011 Allianz policy and its schedule the court held Crystal was an insured to the extent of its respective rights and interests in Warner's Hotel (as owner/lessor and owner of a managed property) and the 2011 certificate was consistent with the policy; accordingly Crystal is entitled to a declaration of insurance cover under the 2011 policy; alternatively, if the court's interpretation were adverse, the defendants would be estopped from denying coverage because they caused Crystal to reasonably rely on the certificate to its detriment.

Court Disposition

Declaration granted that Crystal's interest as lessor and owner of Warner's Hotel was insured under the Allianz 2011 policy; alternatively estoppel in favour of Crystal upheld if interpretation were adverse.
