Under the law as it stood at the time of the offending (pre-2002 amendments) a vessel from which diving was conducted was not a 'place of work' for s16 purposes and Diveco did not have the requisite control of the seabed or water where the hazard (decompression illness) arose; mere ownership or control of the vessel as plant did not make Diveco the controller of the place of work, so the s16 and corresponding regulation charges could not stand.
