Initial unequal monetary contributions did not constitute extraordinary circumstances to displace statutory equal sharing under the Property (Relationships) Act 1976; however, under s 343(f) Property Law Act 2007 the defendant was ordered to pay occupation rent to the plaintiff for sole occupation from 1 September 2008, assessed at $65.00 per week to 21 May 2009 and $17.50 per week thereafter (net of shared outgoings), the specified totals to be deducted from the defendant's one-half share of sale proceeds, and otherwise the consent orders for sale and equal division remain operative.
