Procedural Posture

Appeal From High Court Against Decision Upholding TRA Decision / Court of Appeal Determination on Jurisdiction; Appeal Dismissed

  1. 1 Whether the Court of Appeal has jurisdiction to hear the appeal where the proceedings before the TRA were not a challenge under Part VIIIA of the Tax Administration Act 1994
  2. 2 Whether the Taxation Review Authority is an 'inferior court' for the purposes of s 67 of the Judicature Act 1908
  3. 3 Whether a late Notice of Proposed Adjustment can be deemed accepted under s 89H(2) where it was lodged out of time

Ratio Decidendi

The appeal was dismissed for want of jurisdiction because the proceedings before the TRA were not a challenge under Part VIIIA of the Tax Administration Act 1994 and therefore the appellant had no right of appeal to the Court of Appeal; the TRA is an inferior court and any appeal in these circumstances requires leave of the High Court under s 67 of the Judicature Act 1908.

Orders
