Ratio Decidendi

Because the appellant had not paid security fixed by the Registrar and had not taken the steps required by r 43(1) the appeal was in peril of being treated as abandoned; the Court therefore adjourned the respondent's strike out application and directed the appellant to apply for an extension of time by 5 January 2010, pay the fixed security and any outstanding filing fees, and file a hospitalisation memorandum by 29 January 2010, failing which the appeal will be confirmed as abandoned and the strike out application will not need to be heard.
