The trial judge was entitled to declare the witness hostile because the witness gave evidence inconsistent with earlier statements in a manner appearing unhelpful; re-examination and cross-examination on the inconsistency were appropriate and did not unfairly prejudice the defence; any minor misstatements in the summing-up did not cause a miscarriage of justice; accordingly the extension of time was granted and the appeal was dismissed, affirming conviction and sentence.
