Procedural Posture

Criminal Appeal (sentencing) / Court of Appeal Judgment

  1. 1 appropriateness of 14-year starting point for possession of 1 kg methamphetamine for supply
  2. 2 whether insufficient allowance was made for good character/lack of relevant convictions
  3. 3 whether guilty plea discount was too low

Ratio Decidendi

A 14-year starting point for the discrete offence of possessing 1 kg methamphetamine for supply was within range given the surrounding factual matrix, including evidence indicative of large-scale commercial dealing (notably approximately $1.8m cash). The guilty plea, entered late shortly before trial, warranted a 15% reduction. Personal circumstances did not materially mitigate. Accordingly the sentence of 11.5 years was not manifestly excessive and the appeal is dismissed.
