Procedural Posture

Criminal Appeal Against Sentence / Court of Appeal Judgment Delivered 5 October 2020

  1. 1 Whether the starting point for aggravated robbery was excessive
  2. 2 Whether a discount should have been allowed for the appellant's personal and social circumstances (young adult mitigation)
  3. 3 Whether the aggregate totality adjustment was adequate given cumulative sentences

Ratio Decidendi

Extension of time to file the appeal granted; the starting point for the aggravated robbery was within range but the judge failed to allow a mitigating discount of 18 months for the appellant's social and economic deprivation and young adult rehabilitation prospects; the totality adjustment for cumulative sentences was insufficient and required an overall increase to two years; accordingly the sentence for aggravated robbery was set aside and substituted with four years and six months' imprisonment to be served cumulatively on the existing two years two months' sentence, producing an effective total of six years eight months' imprisonment.

Court Disposition

Application for extension of time granted; appeal against sentence allowed; sentence substituted

Orders

  • Application for extension of time to appeal granted
  • Sentence of six years and six months' imprisonment on aggravated robbery set aside
