Procedural Posture

Criminal Sentence Appeal / Court of Appeal Judgment

  1. 1 Whether the sentencing Judge adopted too high a starting point
  2. 2 Whether discounts for remorse and personal mitigation were insufficient
  3. 3 Whether the discount for the guilty plea was inadequate

Ratio Decidendi

Although the starting point of 10.5 years was within the available range, the trial Judge erred in under‑discounting for remorse and personal mitigation and should have given the full available discount for the guilty plea; adjusting discounts (8% for remorse, 2% for personal factors, 25% for plea) produced an end sentence of seven years one month with a minimum period of three years six months, so the appeal is allowed and the sentence substituted accordingly.

Court Disposition

Appeal allowed; original sentence quashed and substituted

Orders

  • Quash the sentence of eight years' imprisonment and substitute a sentence of seven years one month's imprisonment.
  • Quash the minimum period of four years and substitute a minimum period of three years six months' imprisonment.
