The Panel did not err in law: s 348 did not preclude determination of beneficial ownership under the Deed; the Vesting Act and Deed contemplated independent adjudication of beneficial entitlement and limited the preclusive effect of historic NLC orders for that purpose; the Panel correctly understood its task to determine beneficial owners by reference to mana whenua and tikanga, properly considered post-1893 sales as relevant evidence about continuity and strength of mana whenua, provided adequate reasons for its conclusions, and did not breach natural justice; the Award stands and the appeal is dismissed.
