Ratio Decidendi

The Court has jurisdiction to grant freezing orders in advance of substantive proceedings where there is confidence substantive proceedings are in prospect and the applicant shows a good arguable case, assets subject to restraint and a real risk of dissipation; given the Public Finance Act restriction on Crown indemnities and the constitutional expectation the Crown will satisfy damages, the Official Assignee as a Crown emanation may be dispensed from providing an undertaking as to damages and freezing orders may be granted without such an undertaking, subject to tying the orders to a limited period (30 working days) to allow substantive proceedings to be filed.
