Ratio Decidendi

The Court held that on the balance of probabilities the appellant (decedent) suffered a clinically significant mental injury in the nature of depression that resulted from the 1986 physical injury and therefore the Corporation's revocation of deemed cover for depression was quashed and cover reinstated; by contrast the evidence did not demonstrate that drug dependency or hepatitis C were causally linked to the covered physical injury and the Corporation's revocations in respect of those conditions were upheld; s65 revision power was properly exercised in respect of those revocations and the Public Trust estate is entitled to pursue lawful entitlements arising from reinstated cover.
