On balance of probabilities the Court accepted the evidence of the process servers (particularly Mr Preece) and contemporaneous supporting material (process server report and existence of Freeman's card) over the debtor's denials and unreliable court card; accordingly the bankruptcy notice was served, an act of bankruptcy occurred, and the grounds for an adjudication order were made out.
