Procedural Posture

Civil Declaration and Summary Judgment Application Arising From Resource Management Act Appeal / Summary Judgment Application (declaration)

  1. 1 Whether clause 3.2 of the site access agreement permits Forest & Bird to provide information obtained on the plaintiffs' land to other parties without prior written consent
  2. 2 Whether an Associate Judge has jurisdiction to grant a declaration on a summary judgment application
  3. 3 Whether Forest & Bird breached the site access agreement and has any defence to summary judgment

Ratio Decidendi

Clause 3.2 is clear: the information is the sole property of the farmers and "shall, except with the prior written approval of the Farmers, be used only by Forest & Bird strictly for the purposes of preparing evidence for its appeal and for no other purpose whatsoever"; the word "only" limits who may use the material to Forest & Bird alone and "strictly" limits purpose; accordingly Forest & Bird breached the agreement by making the information available to another party without prior written consent and has no defence to the declaration; the Associate Judge had jurisdiction to grant the declaration on the summary judgment application.
