Procedural Posture

Patent Infringement Appeal / Appeal and Cross Appeal (court of Appeal Judgment)

  1. 1 Whether the term 'bearing' in claim 1 requires a separate physical bearing component or is functional
  2. 2 Whether the pivot pin must be directly connected to the vehicle chassis
  3. 3 Whether the patent should be revoked for inutility raised on cross-appeal

Ratio Decidendi

Taking a purposive construction of the patent as a whole, the Court held that 'bearing' in claim 1 is functional (a bearing relationship between parts) and does not require a separate physical bearing component; accordingly the Steelbro SB361/401 models infringe the patent; the requirement that the pivot pin be 'connected to the chassis' is functional and need not mean direct attachment; the inutility ground on cross-appeal was not permitted and lacked merit.

Court Disposition

Appeal allowed; cross-appeal dismissed
