Procedural Posture

Probate / Trust Dispute (application to Remove Executor and Trustee) / Interlocutory Application Part‑heard; Final Determination on Undertakings and Conditional Replacement Order

  1. 1 Whether the sole executor/trustee (Ivan) should be removed for lack of trust and conflict of interest
  2. 2 Whether the Court should order an independent trustee to investigate alleged improper transfer of the Herne Bay property into a trust
  3. 3 Whether undertakings by the executor are sufficient to protect beneficiaries' interests and obviate removal

Ratio Decidendi

Removal of the sole executor/trustee was not warranted because the respondent's detailed undertakings to treat the Herne Bay property as an asset of the estate, to procure an independent market valuation, provide accounts, allow the beneficiaries purchase opportunities or sale and distribution of net proceeds, and to permit independent accounting oversight were adequate and expedient to protect beneficiaries' interests; consequently the Court made a conditional ('unless') order providing for replacement by the Public Trust only if the respondent did not confirm and implement those undertakings within the specified time, and reserved leave for further orders.

Court Disposition

Application to remove executor/trustee refused on present evidence; conditional 'unless' order that respondent be removed and Public Trust appointed effective 26 June 2014 unless respondent files and serves undertakings implementing the specified proposals by 25 June 2014; directions made for independent accountant...

Orders
