Majority of Court of Appeal held that Miller J's award could not be sustained as a principled exercise of the costs discretion: mere causation that a party's tactical joinder led to another incurring costs after the first party had settled is insufficient to depart from the rule that costs follow the event and to impose liability on a former defendant who has discontinued; awarding costs against a party who settled would risk unacceptable disincentives to settlement and undermine predictability unless additional factors (control, funding, benefit, misconduct or equivalent) place the entity within established exceptional categories.
