McCausland Holdings Ltd v Tesco Underwriting Ltd [2025] NICty 4 (01 July 2025)

McCausland Holdings Ltd v Tesco Underwriting Ltd [2025] NICty 4 (01 July 2025)

Once a bailee has brought and settled a claim for the direct loss (diminution in value) arising from damage to a vehicle, the bailor is precluded from bringing a further claim for the same loss, as both repair costs and depreciation are elements of the same direct loss and cannot be severed into separate claims. The present proceedings are therefore barred by the principles of res judicata and abuse of process.
