The failure by the licence holder of the Brown Cow Inn to notify the clerk of Petty Sessions of the construction of a beer garden at the time of the 2012 renewal rendered the renewal order a nullity and void. Therefore, the requirements of Article 7(4)(e)(ii) of the Licensing (Northern Ireland) Order 1996 were not met, and the application for a new licence by Denmin Limited must fail.
