A direction for 'immediate release' under Article 28(5) cannot lawfully be made contingent upon future events, assessments, or third-party decisions if their fulfilment is uncertain and material to the risk posed by the prisoner. The Parole Commissioners must be satisfied at the time of the direction that it is no longer necessary for the protection of the public from serious harm that the prisoner be confined, and any licence conditions must be capable of being implemented in the immediate future. Release subject to indefinite or uncertain contingencies is inconsistent with the statutory requirement for immediate release and undermines public protection.
