Second Defendant

Procedural Posture

Personal Injury Claim / Interlocutory Application Regarding Amendment of Writ and Regularisation of Service

  1. 1 Whether the plaintiff should be permitted to amend the writ to name the correct defendant after expiry of the limitation period
  2. 2 Whether irregular service of the writ can be regularised under Order 2, rule 1
  3. 3 Whether the plaintiff demonstrated good reason for delay in service and/or amendment

Ratio Decidendi

The plaintiff's mistake in naming the defendant was genuine and not misleading, and the intended defendant was clear. Although service was effected after expiry of the writ's validity, the court exercised its discretion under Order 2, rule 1 to regularise service and allowed amendment of the writ, as the balance of hardship favoured the plaintiff and the only prejudice to the defendant was loss of a limitation defence.

Court Disposition

Plaintiff's application granted; first defendant's application dismissed.

Orders

  • Leave granted to amend the title of the first defendant on the writ of summons.
  • Irregular service of the writ validated and service on 06.01.2014 deemed good pursuant to Order 2, rule 1.
