Procedural Posture

Industrial Tribunal Unfair Dismissal / Final Judgment

  1. 1 Was the claimant dismissed within the meaning of Article 127 of the Employment Rights (Northern Ireland) Order 1996?
  2. 2 If so, was the dismissal unfair?

Ratio Decidendi

The tribunal found no actual or anticipatory breach of contract by the respondent. The respondent's conduct, including the suspension and investigatory process, did not amount to a repudiatory breach of the implied term of trust and confidence. Even if there was ambiguity in correspondence, the respondent's subsequent actions clarified the process and withdrew any threat of breach. The claimant was not entitled to terminate her contract without notice by reason of the respondent's conduct; therefore, there was no dismissal and the claim for unfair dismissal fails.
