SORAS AG v. NAEB

SORAS AG Ltd, as guarantor, is unconditionally liable to pay the outstanding advance payment to NAEB upon first demand, as per the terms of the advance payment guarantee and applicable procurement law, regardless of the value of works performed by EMMR. The guarantee remains valid until the advance is fully reimbursed. The use of the advance in the works does not extinguish the guarantor's obligation. NAEB is not entitled to additional damages for being drawn into litigation, but is entitled to reasonable legal costs.
