The Court of Appeal held that Bank of Kigali Plc's second appeal was inadmissible because it had been defeated on the same grounds in both the Commercial Court and the High Commercial Court, as per Article 52(3) of Law No. 30/2018. Both lower courts found that Bank of Kigali Plc breached the additional loan agreement by failing to disburse the full agreed amount without justification, entitling Gate Hills Estate Ltd to damages and return of collateral. The mortgage on UPI: 1/03/10/01/3975 must be cancelled and the property returned, as the loan for which it was pledged was not fully disbursed.
