BNR is not liable as a direct seller to Ngezahoguhora Ildephonse, as there was no sale contract between them; the obligation to refund the purchase price rests with Ingabire Jacqueline (representing Rekeraho Aloys), who sold the plot to Ngezahoguhora. However, BNR is liable to compensate Ingabire Jacqueline for the loss resulting from its fault in allocating the same plot to two employees, and must also refund the development contribution. Both BNR and Ingabire Jacqueline are jointly liable for part of the legal costs incurred by Ngezahoguhora.
