Procedural Posture

Labour Dispute (employment Termination) / Supreme Court Review on Grounds of Injustice

  1. 1 Whether the respondent was unlawfully dismissed and entitled to damages for unfair dismissal
  2. 2 Whether the calculation of severance pay included improper elements
  3. 3 Whether the respondent was entitled to promotion-related payments

Ratio Decidendi

The Supreme Court found that the so-called independent verification report was not proven to exist or to have been commissioned by BPR Plc, and thus could not invalidate the regular audit report that formed the basis for the respondent's dismissal. The respondent was not unlawfully dismissed and was not entitled to damages for unfair dismissal or promotion-related payments. Severance pay must be calculated based on net salary for two months, excluding work-related benefits. The review on grounds of injustice was properly invoked by BPR Plc, but the respondent could not introduce new claims outside the scope of the original proceedings.

Court Disposition

Partially allowed; lower court decision modified
