Procedural Posture

Commercial Appeal / Supreme Court Judgment

  1. 1 Whether expulsion of sureties from a cooperative extinguishes their liability under a suretyship agreement with a bank.

Ratio Decidendi

Expulsion of sureties from the cooperative and withdrawal of their collateral does not extinguish their liability under the suretyship agreement with the bank, as the agreement remains binding unless the debt is paid or other statutory grounds for extinguishment are proven. The appellants did not demonstrate that the principal debt was paid or otherwise extinguished, so they remain jointly liable.
