The Supreme Court held that Ndayobotse Silas had not complied with the statutory time requirements for appealing the Gasabo Primary Court judgment because, although he indicated an appeal on 22/12/2023, he did not file the appeal grounds and explanations within the required urgent-time period after the judgment copy had been placed in IECMS on 27/12/2023. Therefore, the Gasabo Intermediate Court should not have accepted the appeal, so its judgment was set aside and the Primary Court judgment annulling the auction was restored; as a result, the auction-sale consequences had to be reversed and the buyer refunded only the sums actually received in the auction process, with the owner...
