Procedural Posture

Civil / Supreme Court Final Judgment on Extraordinary Review (impamvu Z’akarengane)

  1. 1 Whether Muhozi Steven is entitled to a share of property acquired during marriage with Nyirambarushimana Triphine
  2. 2 Whether Muhozi Steven can pursue extraordinary review after abandoning a new-fact review
  3. 3 How property should be divided between the surviving spouse and children from a previous marriage

Ratio Decidendi

Only the property jointly registered in the names of Muhozi Steven and Nyirambarushimana Triphine (UPI: 5/01/10/05/871) qualifies as matrimonial property to be divided equally between Muhozi Steven and the children of the deceased. Other properties registered solely in the deceased’s name or her family’s name are not subject to division due to lack of evidence of joint acquisition or contribution. Muhozi Steven’s claim for extraordinary review is admissible since he abandoned the new-fact review before pursuing this remedy. Compensation for legal fees is awarded to the prevailing respondents.

Court Disposition

Applicant’s appeal dismissed; lower court judgment affirmed with modification on legal fees.
