Ratio Decidendi

The estate of Cakadende Jean Baptiste, who died before the enactment of Law No. 22/99, must be distributed according to customary law, which does not allow the widow to inherit but entitles her to maintenance. However, considering her contribution and role, Mukansanga Béatrice is awarded 20% of the estate for her maintenance, with the remainder distributed among all children in specified shares, regardless of which wife bore them. New claims not raised at trial are inadmissible on appeal.
