Gakwaya Aloys failed to pay the remaining purchase price by the contractual deadline, constituting breach. Ndatinya Védaste was not required to perform further obligations, including transfer of property. Only 30,000,000 Frw was proven as paid (less 13,000,000 Frw returned), and Ndatinya must refund the net sum with interest. The lower court erred in ordering transfer of property. No party is entitled to damages or legal fees as both succeeded in part and failed in part.
